THE WATERCOLOR COLLECTION. RULES AND PROCEDURES OF THE WATERCOLOR DRAWING COMPETITION
The Guggenheim Museum Bilbao (hereinafter referred to as the Museum) is organizing a competition that will be open to anyone under the age of 18, born between 2014 and 2022 (represented by their legal representatives) who meets the conditions set out in these rules and procedures.
1. THE ORGANIZER OF THE COMPETITION
The competition is being organized by the Guggenheim Museum Bilbao Foundation, with registered address at Avenida Abandoibarra 2, 48009 Bilbao and Tax ID No G-48832240. This promotion is not sponsored, endorsed or organized in any way by the social networks Instagram and Twitter, which are merely channels through which the competition is communicated.
2. TIME FRAME
The competition will run from April 14, 2025 at 11:00 am until April 30, 2025 at 11:59 pm.
3. FREE NATURE OF THE COMPETITION
The competition is being organized solely and exclusively for advertising and promotional purposes and does not involve any additional charges or fees for the participants.
4. COMPETITION MECHANICS AND PRIZES
4.1 Rules of participation:
4.2 The theme is the Collection of the Guggenheim Museum Bilbao and participants must create a drawing or painting of one of the works in the Collection (https://www.guggenheim-bilbao.eus/en/the-collection/essentials), mainly using watercolors. Entries may be submitted on paper or in a digital format.
4.3 A form will be provided to facilitate participation, and a microsite will be created where participants can post an image of their work. The link to the microsite will be available on the Museum’s social profiles.
The form will request the following information from both the legal representative (so that they can be contacted if they win) and the minor participating in the competition:
4.4 Voting: Voting will take place on the microsite itself, where all eligible entries will be displayed. Voting will commence on April 14, 2025 at 11 am and will end on May 4, 2025 at 11:59 pm. A maximum number of 3 votes can be cast.
4.5 Winners: This competition will have two winners, namely the works that receive the most votes on the applicable microsite. There will be one winning entry for each of the two age categories, as follows:
4.6 Communication: Once the voting is closed, during the following week, the Museum will send a private message on the corresponding social network to the legal representatives of the authors of the winning works. In addition, the winners (only the name of the minor) will be mentioned in the publication that originally launched the competition, along with the username of their legal representatives.
The legal representatives of the authors of the winning works must respond to this message to accept the prize and provide the information requested by the Museum within no more than 1 week from receipt of the message. Should he or she fail to do so, they will forfeit the right to claim the prize.
4.7 Prizes: The winner of each of the aforementioned age categories will receive one of the following prizes: a color-in T-shirt (ages 3 to 5) and a pencil box with a notebook (ages 7 to 11) from the Museum’s Design Store. Each winner will also receive two tickets to invite his or her family to the Museum (free admission for minors).
Under no circumstances may the prizes in this competition be exchanged, altered or compensated for, nor may they be replaced by their cash equivalent at the request of the legal representatives of the winner.
The legal representatives of the winners may refuse their prize but may not pass it on to any third party.
Prizes will be presented to the winners or to their legal representatives, as the case may be, in the manner and place deemed appropriate by the Museum.
In the event of force majeure, the Museum may cancel the competition and inform the legal representatives of the participants accordingly. Any such cancellation shall not give rise to any liability on the part of the Museum and shall not entail any right to compensation on the part of the participants.
5. INTELLECTUAL PROPERTY
The Guggenheim name and the graphic representation of the Guggenheim Museum Bilbao building are registered trademarks. The participants may not use these trademarks or any reproduction, image or photograph of them in any medium or for any commercial or non-commercial purpose other than the competition, without the prior written authorization of the Foundation.
The legal representatives of the participants declare that the drawing or painting they submit is an original, that it has been created individually by the participating minor, and that it does not violate the rights of any third party. They also hold the Museum harmless from any liability with respect to any complaint or claim based on any possible violation of industrial or intellectual property rights related to the drawings or paintings they have submitted to the competition. The participants also declare that their drawing or painting is not contrary to the law, morality or public order.
The legal representatives of the participants, whether or not they are the ultimate winners, authorize the Museum to disseminate the drawings or paintings through the various profiles that the Museum has on the social networks, mentioning the name of the author.
This assignment is understood to be made free of charge, without geographical limitation, and for a limited period of five years from the date of publication of the works.
The Museum reserves the right not to publish any work whose content is not related to the promotion or that is suspected to be the work of another person. It shall also not post any images that contain a photograph or any personal data of a natural person.
6. DATA PROTECTION
In accordance with Organic Law 3/2018 and (EU) Regulation 2016/679, the personal data provided by the participants in the competition will be added to an automated file controlled by the Guggenheim Museum Bilbao Foundation. The purpose of the data processing is to manage this competition under the conditions and in the media set forth above. The data consisting of the name of the minor will be used exclusively to announce the winning works of the contest.
If the information provided by any winning participant contains an error that makes it impossible to identify and/or locate the winner and, consequently, to award the prize, the Museum will be exempt from awarding the prize and from any other liability.
The Foundation guarantees the security of the processing, as well as the rights of access, rectification, deletion, portability, limitation and opposition to the processing. You may exercise these rights by sending an email to dpo@guggenheim-bilbao.eus or a letter to Abandoibarra Etorbidea 2, 48009 Bilbao. If you are not satisfied with the way the above rights have been handled, you are also guaranteed the right to file a complaint with the Spanish Data Protection Agency. 7. GENERAL CONSIDERATIONS
7.1 The Museum shall not be held responsible for any possible loss, theft, delay or any other circumstance attributable to a third party that may affect the running of this competition or the full or partial enjoyment of any prize. Nor shall it be held responsible for the use made by the participants of any prize awarded in this competition.
7.2 The Museum shall be held harmless from whatsoever form of legal liability once the prizes have been awarded to the winners.
7.3 These legal rules and procedures will be available to participants on the microsite that will be hosted on the Museum’s social profiles.
7.4 Participation in the competition implies that the participants accept these rules and procedures, as well as the Museum’s criteria for resolving any incidents related to the promotion. The Museum may disqualify any participant who fails to comply with these rules and procedures.
7.5 The Museum reserves the right to amend these rules and procedures and to cancel the competition at any time if it were to be unable to ensure the smooth running of the competition.
